It's actually a little more complicated than that, Dutch. The Supreme Court decided that they didn't need to intervene at this time because every Federal Court case has been ruled in the same way, which is that gay marriage bans in the states they oversee are unconstitutional. Since all of the courts were in agreement, the Supreme Court doesn't necessarily need to step in and play referee. They actually just gave the green light for gay marriages to go ahead in a handful of more states by doing nothing at all. Thirty states will now have gay marriages and more are undoubtedly to follow.
