I don't know if Justice Roberts or Justice Kennedy disappointed me with their sheer ignorance of reproductive health and science. Chief Roberts claimed that a companies belief that the morning after pill is an abortion is more than enough to green light a religious exemption to a Federal law. It doesn't matter if that belief is based on any fact whatsoever because it's a belief. Not to be outdone, Justice Kennedy suggested the Governments reasoning would give Congress the authority to force companies to pay for abortions. He must have forgotten the part of the ACA that explicitly forbids that. Facts be damned, this court is intent on conflating birth control with abortion coverage.
The one shining moment of today's hearing was the courts three female justices line of questioning. They put Paul Clement, the lawyer arguing that private companies should be exempt from a law because they feel like it, back on his heels with their questions. It should not go unnoticed that every female on the court seemed ardently against Hobby Lobby's case. That may not matter though because a bunch of old men feel they have the power to control the health decisions a woman can make. It really makes me wonder if this great country of ours truly is as great as we keep telling ourselves.
