What do you think? Should former President George W. Bush be tried for his war crimes, particularly the allegations against breaking the laws against torture?

No. I do not think that is a good idea. President Bush was acting on advice of legal experts.  And some experts do not consider water boarding to be physical torture.

But he acted of his own volition to take advice on those legal consultants, and had the option no to act of such faulty intelligence. If I conspire to commit murder on someone's intelligence or tip for a certain target, I mess up and kill the wrong target I am implicated as well upon the crime. His neocon crusade killed 6000 American troops and has cost us billions of dollars, he is a criminal through and through and should be charged as one.

He's obviated his "expert advice" dodge by relying on biased experts.  By selecting experts of a particular bias,  he's
ensured a selected outcome.  Which therefore means that there was really no choice being made at all!  Alternative
opinions were not examined or refuted,  but rejected out of hand,  for partisan,  emotional,  biased and/or poltical reasons.
Meaning that no real examination of the alternatives was engaged.

For example when Wilson came back from Africa to deliver a report on the yellow cake matter,  not only was
his report ignored/refused/rejected or not recieved,  but he was attacked via the outing of his wife.  All of which
means that any attempt by the Bush adm.,  to claim that it was following the best advice it had or could get,
is false,  and any claims that it was receiving unbiased reports is a sham.   The decision to invade,  whether
legally or illegally,  with or without UN authority had been made before hand.  That decision was not to be
altered by any argument or any reports,  contrary material or facts.

Thus,  either the laws that have been approved,  decided and passed,  must now either be enforced or
be consigned to meaninglessness.  Which will make the arts of legislating worthless fools errands.

I'm basdically willing the give GWB a little leeway on war crimes because the US Congress is responsible for passing laws.  Congress as a whole should be immplicated in your claim for War Crime Justice.
A further note re: Congress v. POTUS - if Pres. Regan was permitted to FIRE the Air Controllers, then Pres. Obama should be allowed to HIRE (reinstate) the FAA workers and airport contractors/laborers. Congress is derelict in it's duty to the taxpayers/voters.  If the members were in the military, most of them would be charged with 1) Dereliction of Duty and 2) DESERTION.  Let's get them back to work doing what they were hired for!  Current Congressional actions border on War Crimes because there is no Peace or Tranquility in Washington, D.C.

Bush and Cheney are WAR CRIMINALS. MY father-in-law ,who is my personnel heroe, served in WW2 and Korean war . He was captured in Korea and held as a prisoner of war. During his captivity he was tortured repeatedly, removing fingertips, hot rods burning holes into his skin and similar BUsh Cheney mind bashing. He never cracked, until long after his release. ANY and i mean "ANY" torture in the name of ANY cause is TORTURE!!!  Prior to the B&C admin. the U.S. was proud to say they stood on the side of "JUSTICE FOR ALL". Bush and his admin. choose to go against the U.N. as well as many civil countries. Cheney commanded the President and his forces, CIVILIANS or MILITARILY to do the things Bush politically shy'd away from. I personnally hold them responsible for 911 and the events following during the Bush Cheney Admin.

Yes...Human rights violations, as well as not protect the US  Constitution.  Cheney even admited to Matt Lauer that he would continue waterboarding.  Lying to the American Voter,  Invading a Soverign Nation without UN Authorization. Try them!

I'm a Libertarian (Ron Paul supporter) - just to let you know where I'm coming from - I'm not posing as a Dem, I just like to read all opinions -

I was in complete agreement with you David in Denver...until "without UN Authoriztion" Are you serious? I don't remember anything in the Contistution about the President and Congress requiring UN Authorization to do squat. As far as war crimes go, George W for starting the wars and Obama for letting them continue AND throwing Libya in there as well, that's an illegal war. Oh, sorry it's not a "war", we're just, like, bombing them.  According to the Constitution the role of our military is to DEFEND OUR NATION - not nation building.

Conquest is not in our principles. It is inconsistent with our government.

The Bible says "Do unto others as you would want them to do unto you."  If Bush & Cheney both like to do waterboarding so much, that they'll not stop doing it, even if it doesn't produce any useful results

Well, then THEY ASKED FOR IT.  I would suggest we put them into one of those cute little outfits we have seen used on the detainees at Abu Ghraib -- little sponge bob hats & bat wing drapey robes. They would then be kept blind-folded, & shackled, while growling slobbering German Shepherd DOGS bark & drool in their faces at close range. A few lashes of the whip, a few days of starvation, & they should be ready for the FUN PART. Come boys, to the WaterPark of BushWorld. Dunk in water, Turn up heat.
