I was amazed to read this Change.org article by Alex DiBranco about a mother losing her rights to a newborn, healthy baby because she refused to sign a pre-consent form for a C-Section.  But that's what happened to a couple following a natural birth with no complications. Her baby was taken away from her by the hospital on "charges of endangering child welfare."

As DiBranco points out, "Fortunately, the courts agreed that the child abuse/neglect statutes do not apply to fetuses, and in a previous warning, refusing a c-section specifically was found to not constitute endangering a child's welfare."

But after 3 years, the couple still does not have their baby back because they are facing additional charges from the hospital of "acting irrational, hostile, and yelling."

Opinions? If the baby had died in child birth, would it have made any difference?

Is this a friggin' joke?  I mean.....Are they Serious?  This happened....in America?  I mean...I've seen my share of stupid and evil in my time....but this... this is Too Much, it just can't be true.  Why do things have to come to This?

Unfortunately it is not a joke.  You can read more about the legal details of the case in Opposing Views.

What is crazy is that the parents have been denied legal custody for three years while the case has been tied up in courts. It could drag on even longer if the ruling is appealed.

Does anyone care about the welfare of the child other than the parents? The first three years of the baby's life have been denied to the parents.  That's the real tragedy.
