There are two questions that we need to ask to determine if affirmative action is necessary today.
1) Is there prejudice against any classes today?
First, many people believe that racisim itself no longer exists. However, one study conducted at Urban Institute looked at employment practices by recruitng presentable black and white college students and gave them all the same resume. The result was that Whites received job offers 41% more than blacks and were offered wages 17% higher. Additionally, whites were told of additional job opportunities 48% of the time. Erwin Chamerinsky, 27 Golden Gate Univ. L. Rev, 315 (1999).
In addition to racisim there are other classes that face prejudicism. One of which is women. It is still common knowledge that women recieve less pay than men. I have read studies that say it is because women don't negotiate during the hiring process. To me that seems to be an excuse.
The bottom line is that there is still prejudice today, it's almost as if it is an unconcious prejudice, people don't believe that they do it and yet they do. This is the worst kind, because if they don't think they treat certain classes of people differently, there's not much you can do to prove it to them otherwise.
2) Does affirmative action help?
It has in the past helped break down barriers in the battle against racisim. Today is helps break down barriers as well for women and people that are handicaped as well as ethnicity. Are there down sides? Sure. But does it help. Yes. It at least forces us to realize to some extent that prejuice still exists.

It seems the first problem here is determining what Affirmative Action is....and worth remembering, that whatever it is, it was Nixon who signed off on it.
1.) The private sector is only held to racial quotas for new job hirings, when that buisness or corporation is guilty of past discrimination. The penalty for discriminating against minorities ...can lead to restitution in the form of quotas affecting new hiring...
2.) We have Affirmative Action in the public sector for the same reasons we see it in the private sector, as restitution for past discrimination, but this time for that which was practiced by the government
Affirmative Action is a penalty for infringing on other people's liberty. Everyone deserves the right to be judged for the content of their character, not for personel demographic information that hardly matters when it comes to ones ability to do a job. Obviously, male strippers aren't going to be hired for a job at Baby Dolls, not unless a sh&t load of macho youth and morally depraved conservatives go bi-sexual. but the point here is that race, orientation, and gender do not affect one's ability to do most jobs....and discrimination on these grounds violates more than just our common decency, but the essential liberty for which our Republic is supposed to stand. Buisness ownership in the United States of America is a voluntary choice...and ultimately, if you make that choice, you agree to abide by the laws of the land governing your operations. We have the opportunity to produce wealth, not solely because of own efforts, but because of the protection afforded by the government...ultimately, social disturbances effect private liberties....by running against the grain of common decency, by practicing genuine discrimination in a business setting, one fans the flames of anarchy in our society. If you can't get a job, because your skin is the wrong color...what the hell are you supposed to do to feed your family? You either get in the welfare line, or you can try your hand at a life of crime. Hell, you can do both, you can thug it out on that gov't cheese. The point, which I am an expert at coming to, is that discrimination prevents people from being able to stand as their own person, transforming them into the vehicles of their own oppression. That's that Thug-O-Nomics....The Bloods and Crips are Uncle Toms! Hell, they're selling dope for the white man, and to their own people! Jesus, now I won't be able to go anywhere in South Central L.A.
