The law suit against what would be proposition 14 alleges that it is unconstitutional because it disenfranchises voters by not counting votes for write-in candidates in the general election, and that it "unfairly censors and discriminates" against candidates from minor parties.

Proposition 14 is attempting to create an open primary election and thus would eliminate the current system for state and congressional races and allow people to vote on candidates regardless of the voter's own party registration. The top two vote-getters, regardless of party, would be on the ballot for the general election.

The hearing for the lawsuit is scheduled for Sept. 3 in San Francisco Superior Court, with Judge Charlotte Woolard.
